Limitation of Liability

To the fullest extent permitted by applicable law, Electric Drive Solutions, its owners, employees, agents, suppliers, and affiliates shall not be liable for any damages of any kind, whether direct, indirect, incidental, consequential, special, exemplary, or punitive, arising out of or related to the purchase, installation, use, misuse, or inability to use any product sold.

This limitation includes, but is not limited to, personal injury, bodily injury, death, property damage, loss of use, loss of profits, loss of data, loss of business, downtime, towing costs, labor costs, installation or removal costs, or any other economic or non-economic loss, regardless of the cause.

Use at Your Own Risk

All products sold by Electric Drive Solutions are sold “as-is” with respect to application and use, except where expressly stated otherwise in a written warranty. The customer assumes all responsibility and risk associated with:

• Proper product selection
  
• Installation
  
• Configuration
  
• Electrical compatibility
  
• Environmental suitability
  
• Compliance with applicable codes, regulations, and safety standards
  

No Responsibility for Improper Use or Application

Electric Drive Solutions shall not be liable for damages resulting from:

• Improper installation, wiring, programming, or configuration
  
• Use outside of published specifications or ratings
  
• Incompatible components or systems
  
• Modification, repair, or alteration by any party other than Electric Drive Solutions
  
• Negligence, misuse, abuse, or unintended application
  
• Failure to follow installation instructions or safety guidelines
  

No Liability for Third-Party Actions

Electric Drive Solutions shall not be responsible for damages caused by:

• Shipping carriers
  
• Installers, technicians, or service providers
  
• End users or third parties
  
• Vehicle or equipment manufacturers
  
• External electrical systems, chargers, or power sources
  

Maximum Liability Cap

In no event shall Electric Drive Solutions’ total liability, if any, exceed the original purchase price of the product giving rise to the claim.

Exclusive Remedy

The customer’s sole and exclusive remedy for any claim related to a product shall be limited to, at Electric Drive Solutions’ discretion:

• Repair
  
• Remanufacture
  
• Replacement of the product
  

No other remedies, including refunds or damages, are implied or guaranteed.
